Once again, New York Attorney General Letitia James has a significant monetary sanction of $12 million and significant reforms against a Bad Nursing Home.

VDRNC, LLC: Van Duyn Center for Rehabilitation and Nursing, Syracuse, New York. Its owners and operators “received millions of dollars of taxpayer funds meant for resident care, leaving the nursing home severely understaffed. Residents suffered in unsafe conditions, leading to hospitalizations, deaths, and significant trauma.”

As stated in the press release:

• A resident died after Van Duyn failed to properly communicate her care plan to staff. They neglected to assist her to the bathroom. She fell in her room, and her nightgown caught on a door handle, strangling her to death. Tragically, nursing home staff remained unaware until they later discovered her deceased.
• Van Duyn’s blatant neglect—failing to provide care, administer medication, monitor skin, and respond after a fall—directly caused the resident’s death, later discovered in rigor mortis.
• Van Duyn failed to properly monitor and treat the resident’s glucose levels, which forced the resident’s transfer to the hospital.
• Van Duyn ignored the resident’s rapidly deteriorating condition, leading to hospitalization for a bacterial infection, bed sores, and dehydration.
• Van Duyn inappropriately discharged multiple residents and left them at a Department of Social Services office without identification. This placed them at serious risk of harm.

AG James’ list of meaningful results: A $45 million sanction against Centers for Care in November 2024. In December 2022, the court ordered a monitor to oversee Cold Spring Hills Center for Nursing and Rehabilitation. Building on that success, in March 2024, she obtained an $8.6 million sanction against Fulton Commons.

Centers for Care owns and operates several nursing facilities across New York. These include: Beth Abraham Center in Bronx County, Buffalo Center in Erie County, Holliswood Center in Queens County, and Martine Center in Westchester County.

Cold Spring Hills Center for Nursing and Rehabilitation: Cold Spring Hills, Oyster Bay, Nassau County.
We applaud AG James. These are tremendous steps on a long path. These owners and operators have harmed residents and their families. Additionally, preventable injury and death costs all of us.
