Understanding Construction Accidents

At Adams Law Firm, P.C., our Bronx County injury lawyers understand that construction sites present dangerous and often fatal work hazards. The machinery, tools, ladders and scaffolding involved with most projects can create an environment poised for catastrophic work site accidents.

Our New York City construction accident attorneys are led by Jeffrey M. Adams, who has been representing accident victims and the families of wrongful death victims for nearly a quarter of a century. His extensive experience handling construction site accidents provides him with unique insights into the construction industry.

Gross Negligence

Our experience has shown us that most construction site accidents are caused by negligence. Supervisors and owners tend to put a priority on completing jobs quickly without protecting the laborers working underground, inside the premises or at the site.

We understand the physical and financial hardships associated with construction site accidents and personal injuries. Our skilled and dedicated lawyers conduct thorough investigations to determine liability. We have extensive experience with cases involving:

  • Poor supervision
  • Improper safeguards
  • Falling objects
  • Inadequate training
  • Faulty equipment and machinery
  • Asbestos exposure
  • Swollen or bleeding gums

For more than 50 years, Adams Law Firm, P.C., has diligently protected and promoted the rights of injured New Yorkers. Our attorneys will evaluate your accident from every angle to determine the best course of action.

Remember: your employer is obligated to put your safety above all else.

Case Focus: Dom

Dom was a laborer whose job was to clean up the debris from the other workers on the site.

While working on a scaffold, and due to no fault of his own, he fell to the ground approximately 20 feet below.  This is significant, because at the time there was a legal obstacle that required a fall to be 20 feet or more.

The cause of the fall was the failure of the general contractor to safely oversee the work site, and of the scaffold company for their failure to ensure that safety harnesses were provided, and guardrails were in place.

There was a dispute as to how high the scaffold was.  The defense that the scaffold was not quite 20 feet.  We argued that the scaffold was slightly over 20, and that if it was not, it was a miniscule difference of only a few inches that perhaps was miscalculated and should not be held against Dom.  Fortunately, the judge agreed.

Dom landed on his feet.  He fractured his left femur and had fractures to both feet.  This case is particularly memorable for me, as it was one of only a few cases that my father and I tried together.  We were able to achieve a settlement for a client that helped provide financial security for him and his family.

With the waiver of a workers compensation lien of over $100,00.00 and the interest in the structured annuity, the total settlement was substantially over $1,000,000.00.

Long-Term Needs

In any personal injury case, our first priority is addressing our clients’ short- and long-term needs. We recognize that construction site injuries are often devastating, involving falling from heights, shattered bones and traumatic brain injuries. These injuries often limit a worker’s earning potential.

We never back down from insurance agencies or defendants. We diligently fight to obtain full, fair and complete recoveries for our clients. We consult with medical and financial experts to establish your long-term medical needs and financial outlook. Their in-depth testimony can also illustrate the serious nature of your situation to the insurance company and a jury.

A Note to Undocumented Workers

You have the right to pursue legal action and receive compensation for your work-related injuries. You are protected under the law and bringing a claim WILL NOT affect your status. Please call us today at 888.MY 911 LAW (888-699-1152) to discuss your situation.

Remember: Accidents that occur on construction sites can have devastating consequences for those affected. You are entitled to justice if your life is significantly impacted.
