Case Focus: Dom

Dom was a laborer whose job was to clean up the debris from the other workers on the site. 

While working on a scaffold, and due to no fault of his own, he fell to the ground approximately 20 feet below.  This is significant, because at the time there was a legal obstacle that required a fall to be 20 feet or more.

The cause of the fall was the failure of the general contractor to safely oversee the work site, and of the scaffold company for their failure to ensure that safety harnesses were provided, and guardrails were in place.

There was a dispute as to how high the scaffold was.  The defense that the scaffold was not quite 20 feet.  We argued that the scaffold was slightly over 20, and that if it was not, it was a miniscule difference of only a few inches that perhaps was miscalculated and should not be held against Dom.  Fortunately, the judge agreed.

Dom landed on his feet.  He fractured his left femur and had fractures to both feet.  This case is particularly memorable for me, as it was one of only a few cases that my father and I tried together.  We were able to achieve a settlement for a client that helped provide financial security for him and his family.

With the waiver of a workers compensation lien of over $100,00.00 and the interest in the structured annuity, the total settlement was substantially over $1,000,000.00.
